Sue the ***** – Solve the Problem
What: Dan Galpern will talk about what it will take to win, and what ‘winning’ means in terms of dangerous climate change. The role of fossil fuel companies has been ignored at UN climate conferences. A number of lawsuits target such “bad actors” for local damages, to compensate local jurisdictions for necessary expenditures for infrastructure fortification against rising seas and other climate-induced harms. These cases are in their early stages because the carbon majors are fighting them tooth and nail. A glaring inadequacy is that no highly vulnerable nation has yet attempted to hold the carbon majors liable for such damages. Dan will have several one-page fact sheets to share on ‘worst case’ scenarios for highly vulnerable nations. The role of the major industrialized nations in maintaining high fossil fuel consumption and high emissions has been masked. That veneer is increasingly being stripped away as society demands climate action. Lawsuits against governments citing the gap between international commitments and national follow-through seem especially promising, as evidenced by an important case in the Netherlands that has achieved notable success — even though an appeal to that state’s Supreme Court remains pending.
